Introduction & Acceptance of Terms & Conditions
- Thank you for choosing Balaji Trips. Please read these Terms and Conditions ("Agreement") attentively before using the services offered by Balaji Trips ("Company," "We," or "Us"). This Agreement outlines the terms and conditions that govern your use of our travel services. You ("the Customer", “the client”, or “the guest”) acknowledge and agree to be bound by these Terms & Conditions by making a booking or engaging in any transaction with the Company. Please refrain from utilizing our services if you disagree with any portion of these Terms and Conditions.
- These 'Terms and Conditions', along with other booking-related terms and communications sent periodically, constitute the entirety of the agreement between Balaji Trips and you.
- ‘Terms and Conditions’ extend to all travel-related services, including but not limited to flight bookings, accommodation arrangements, transportation services, tour packages, travel insurance, and visa assistance done by “Balaji Trips”.
Definitions
- "Travel Company," "we," "us," or "our" refers to Balaji Trips, the entity providing travel services. The Company acts as an intermediary between the customer and various service providers to facilitate travel-related bookings and arrangements.
- "Client," "customer," “guest” "you," or "your" refers to the individual or entity availing themselves of our travel services.
- "Service(s)" refers to any travel-related service, including but not limited to flight bookings, Hotel reservations, transportation services, tour packages, travel insurance, and visa assistance. Services may be subject to additional terms and conditions imposed by third-party providers, such as airlines, hotels, or tour operators. By using our services, you acknowledge and agree to comply with any such additional terms and conditions.
Booking and Reservation of service(s)
- A customer or a guest must be eighteen (18) years or above to make a booking.
- To book any travel service, you must provide accurate and complete information as required by our booking process. This includes details of passengers, passports, PAN cards, travel dates, and any specific document for Visa documentation.
- All bookings are subject to availability and confirmation by our company. We reserve the right to decline any booking request.
- In case, the booking formalities are processed by the guest on behalf of his/her family, s/he is deemed to have been authorized to do so by his family members after reading, understanding, and accepting all the Balaji Trips ‘Terms and Conditions mentioned on the website.
- The Company will confirm the booking and provide a booking reference number or a voucher upon receipt of full payment.
Payment
- Prices quoted for services are subject to change in unseen circumstances. Any increase in the price of a service will be communicated to you, and you will have the option to pay the additional amount or cancel the booking.
- All prices quoted are in the currency specified at the time of sharing a quote and are subject to change without notice. Additional taxes, fees, and surcharges may apply, as determined by the respective service providers or government regulations.
- Payments must be made in full at the time of booking unless stated otherwise. We accept various forms of payment, including credit cards, bank transfers, or other methods as specified on our website or agreed upon with the customer.
- Government taxes are not included in the price of the tour and must be paid separately. In accordance with current government regulations, 5% GST (Goods and Services Tax) is applicable on every tour/package, and visitors must pay the tax in addition to the tour price.
- Furthermore, from October 1, 2020, the government will levy TCS (Tax Collected at Source) on the GST including tour/package pricing of international/overseas travel packages. The TCS collected can be claimed while filing annual income tax returns. Once the TCS amount has been collected from the visitor, it cannot be refunded because it has been paid to the government and reflected on the guest's Form 26AS.
Travel Document and Requirement
- It is the customer's responsibility to ensure they have valid passports, visas, required vaccinations, duly filed health declarations, and any other necessary travel documents for their intended destination.
- The Company shall not be held liable for any expenses, losses, or damages incurred due to the customer's failure to comply with travel requirements. These expenses may include but are not limited to denial of entry, deportation, or any associated costs or losses.
- We may provide assistance and guidance in obtaining visas and other travel-related documents. However, we do not guarantee the issuance of any visas or travel permits and are not responsible for any delays, rejections, or other issues arising from the visa application process.
- Any hike in visa fee/ VFS charge/service charge between the tour launch and visa application date must be borne by the customer or a guest.
- When the customer books the tour, it is assumed that the customer is physically and mentally competent to travel to that destination. Throughout the tour, it is essential for the customer to take care of his or her health and carry any necessary medications with a doctor's prescription. Any health-related costs incurred during the tour are the sole responsibility of the customer, and we assume no liability whatsoever.
- You are responsible for obtaining adequate travel insurance coverage to protect yourself and your belongings during your trip. We recommend reviewing the coverage details and terms of the insurance policy before purchasing. Any claims or disputes regarding insurance coverage are between you and the insurance provider.
Changes in the services
- Balaji Trips acts as an intermediary between the customer and various service providers like airlines, hotels, and local tour operators to facilitate travel-related bookings and arrangements. Due to this, we even have to rely on their services and terms & conditions. By using our services, you acknowledge and agree to comply with any such additional terms and conditions.
- Tour Itinerary - Balaji Trips makes every effort to adhere to the tour itinerary provided at the time of booking confirmation. In many cases, however, alterations to the itinerary may be necessary due to factors such as, but not limited to, weather conditions, traffic problems, cancellation or re-routing or overbooking of flights/ cruises/ local trains, overbooking or closure of hotels, closure of entry to a tourist attraction, etc. Guests will be informed via email, text message, phone call, or by our travel expert or the local service provider while on tour.
- In case any sightseeing place is not visited adventure activity is not done or transportation mode is required to be changed due to certain reasons then an alternate sightseeing activity or transport may be arranged, wherever possible. If an alternate cannot be arranged and a refund is applicable, then it shall be paid in INR only.
- Any booked tour/ package/ service which includes helicopter, seaplane, cruise, train ferry, etc. would be subject to availability/ weather conditions/ local body permissions/ any other statutory requirements. Balaji Trips is not responsible for any operational deficiency under any circumstances whatsoever. Guest may note that changes in the itinerary are due to various factors beyond our control, Balaji Trips shall not be liable to pay any compensation/ damages on account of the same.
- Airline – When you book an air-inclusive tour or air ticket with us, it is understood that you are accepting the Airline's Terms & Conditions, including travel, baggage, meals, and services. Any additional expenses incurred due to discontinuation of airline service, change in route, delays, etc., must be borne by guests.
- We provide baggage allowance information in advance to the customers. Customers should also check and adhere to the baggage allowance and conditions of the airline/s they are traveling with. Any excess baggage charge should be borne by the customer.
- In-flight meal service is at the discretion of the respective airline. Veg/ Non-veg meal requests and/or special meal requests are to be informed at the time of booking and are subject to availability with the airline. We are not responsible for the unavailability or quality of requested meals.
Cancellation and Refund
- Cancellations by the Customer: If the Customer wishes to cancel a booking, a cancellation request must be submitted in writing to the Company. Cancellation fees may apply, and the amount refunded will depend on the Company's cancellation policy and any applicable terms and conditions of third-party suppliers.
- Cancellations by the Company: The Company reserves the right to cancel or reschedule bookings due to unforeseen circumstances or events beyond its control. In such cases, the Company will make reasonable efforts to provide suitable alternatives or offer a refund to the Customer.
- Refunds: Refunds, if applicable, will be processed within a reasonable timeframe. We will communicate the refund process and any associated costs to you upon request or in accordance with the specific provider's policies. The Company reserves the right to deduct any applicable cancellation fees or administrative charges from the refund amount.
- Some bookings, such as non-refundable airline tickets or hotel reservations, may not be eligible for cancellation or refund. It is essential to review the terms and conditions before making such bookings.
- The company is not liable to pay any interest on the tour amount paid by the guest/s.
- Tax Collected at Source (TCS) for international tours is non-refundable as it is deposited with the income tax department and recorded on the guest’s registered PAN. TCS once paid cannot be reversed, however can be claimed by the guest while filing their annual Income Tax Returns.
Liability and Responsibility
- Limitation of Liability - To the extent permitted by applicable law, our liability, whether in contract, tort, or otherwise, shall be limited to the amount paid by you for the specific service in question. However, the Company shall not be held liable for any loss, damage, injury, or inconvenience caused by third-party suppliers, transportation providers, natural disasters, accidents, delays, or any other factors beyond its control.
- Indemnity: The Customer agrees to indemnify and hold the Company, its employees, agents, and representatives harmless from and against any claims, damages, losses, or expenses arising out of the Customer's breach of these Terms or any negligent or unlawful act or omission by the Customer.
Intellectual Property
- All content, including text, graphics, logos, images, and software, provided on our website or through our services, is the intellectual property of the Company and is protected by copyright and other applicable laws.
- You may not reproduce, distribute, modify, or create derivative works of any content without our prior written consent. Unauthorized use of our intellectual property may result in legal action.
Severability
- If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Entire Agreement
- This Agreement constitutes the entire agreement between you and the Company regarding the use of our services and supersedes any prior agreements or understandings, whether written or oral.
